Overview

Tibor “T” Nagy is a trial lawyer who represents plaintiffs and defendants in high-stakes litigation in state and federal courts throughout the United States.  Tibor has been lead counsel in bet-the-company cases ranging from patent infringement disputes to complex class actions.  Tibor regularly represents Fortune 500 companies, hedge funds, leaders in the cryptocurrency and commodity industries, individual business owners, executives, inventors, patent owners, and high-net-worth individuals.  Tibor also is hired by other lawyers when they need representation.

Tibor typically represents clients, whether plaintiffs or defendants, on an alternative fee basis, so that most or all of his fee is based on success rather than hours.  Tibor does not specialize by subject area, but rather handles all types of complex civil litigation.  Clients often hire Tibor shortly before trial to take over and try their cases if and when they actually proceed to trial.

Tibor has been recognized in numerous publications for his accomplishments, including Crain’s as a Notable Hispanic Leader & Executive, Benchmark Litigation, National Law Journal, and Litigator of the Week.  Tibor is a member of the Hispanic National Bar Association.  He is a graduate of Yale Law School and Dartmouth College.  He is admitted to practice in New York, New Jersey, Connecticut, Texas and federal courts across the country.  Before founding NWA, he was a partner at Dontzin Nagy & Fleissig and at Susman Godfrey.

Representative Matters

  • After replacing another firm as lead counsel, recovered over $900 million for individual client in breach of contract and tortious interference dispute.

  • Retained as lead counsel by large financial institution just months before trial in multibillion dollar case in New York state court that had been litigated for nearly a decade by another firm—settled matter favorably two weeks into four-week trial.

  • Obtained complete victory for prominent artist following two-week trial in federal court in Chicago in tortious interference suit, with court awarding client over $2.5 million in attorney’s fees.

  • Retained as lead counsel by large insurer one week before trial in class action seeking nine-figures in damages in New York state court—convinced unanimous jury to rule in favor of client following three-week trial.

  • On behalf of major brokerage firm in fraud action, prevailed in one-week arbitration in Florida, with panel awarding attorney’s fees in favor of client.    

  • On behalf of major brokerage firm in breach of contract and fiduciary duty action, prevailed in one-week arbitration in New York.

  • Retained as lead counsel by large insurer just two months before trial in New York state court—settled matter favorably on eve of trial.

  • Obtained eight-figure settlement on behalf of inventor of life-saving drug in breach of contract earnout arbitration against multinational pharmaceutical company.  

  • Obtained summary judgment in federal court in Boston for large financial institution in fraud and breach of fiduciary duty action seeking tens of millions of dollars in damages.  Simultaneously convinced FINRA panel to grant motion dismissing all claims in related FINRA action filed by plaintiffs.

  • Defended ConsenSys against trade secret misappropriation claims in EDNY, obtaining complete dismissal of all claims and settlement in which plaintiff was forced to pay ConsenSys a confidential sum.

  • Named Litigator of the Week finalist for securing on behalf of ConsenSys AG and Ethereal Ventures the dismissal of a $500 million RICO class action in Delaware federal court.

  • On behalf of two prominent art gallery owners, retained to argue appeal in multimillion dollar dispute involving a Rothko in federal appellate court, which unanimously reversed trial court and entered judgment in favor of clients.

  • Defended international law firm in defamation case brought by Facebook and Mark Zuckerberg in New York state court.  After trial court denied motion to dismiss, obtained emergency order from New York’s appellate division staying discovery, and then successfully obtained unanimous reversal and judgment in favor of client, resulting in complete victory.

  • Obtained complete dismissal on summary judgment of $13 billion RICO suit filed against hedge fund client and successfully defended that dismissal on appeal.

  • Hired by large financial institution to defend against four patents in infringement action brought by Intellectual Ventures—obtained order invalidating three patents and Intellectual Ventures dismissed all claims on final patent after we filed motion for sanctions.
